Terms and Conditions


Please note that these Terms and Conditions apply to all of our tours taking place between January 2013 and December 2013. It is important that you read all of the Terms and Conditions carefully.

What is included in the E-Tours All-Inclusive Trip Fee?

• Round trip airfare unless stated otherwise (including airport taxes and fuel surcharges up to $400.00)
• Airport transfers from arrival airport to hotel and from final destination hotel to departure airport
• All transportation between cities on itinerary
• Local public transportation to all scheduled activities on itinerary
• All accommodations in carefully-selected hotels
• All breakfasts and dinners provided on a daily basis unless otherwise specified at the outset
• All local sightseeing tours led by local guides as per itinerary
• Personal travel insurance
• Tips for local sightseeing guides and bus drivers
• All entrance fees to attractions listed on the itinerary

What is not included?

• Airport taxes and fuel surcharges in excess of $400
• Baggage Surcharges assessed by airlines
• Surcharges due to changes in currency exchange rates
• Single/Double room guarantee supplements
• Lunches, unless specified on the itinerary
• All meal time drinks, except water
• Unforeseen expenses due to last minute airline rescheduling or delays, or events beyond ETours’ control
• Passport and Visa costs
• Porterage

Signing Up

Complete the Application Form and send this, together with the non-refundable deposit by way of a personal check made payable to “E-Tours”. Acceptance of late Application Forms will be subject to Tour Director’s discretion as well as flight and hotel availability.
The participant is responsible for providing E-Tours with their full name as it appears (or will appear) in their passport. Any changes to Participants’ names already ticketed will incur a minimum $150 fee per airline.
• All checks must be made payable to “E-Tours”.
IMPORTANT! If any sums owing to E-Tours are not paid in full not less than 60 days prior to the departure date, your reservation may be cancelled and such cancellation shall be subject to E- Tours’ standard cancellation policy.

Late Applicants

Full payment for the tour will be required from you upon acceptance of the Application Form and you will also be responsible for any additional tour costs which may be necessary. No
Application Forms will be accepted less than 45 days prior to the departure date.

Cancellation Policy

E-Tours shall make the appropriate reservations for each Participant. In the event you cancel, you must notify E-Tours in writing. You will be responsible for any costs that E-Tours incurs.
The written notice of cancellation must be provided by the Participant, or in the case of a minor, by the parents or legal guardian. Please send cancellation notices to E-Tours’ by post, fax or e-mail. E-Tours may at its absolute discretion, at any time including during the tour, refuse to carry any Participant whose conduct or manner causes, or is likely to cause, offense or upset to other Participants, and E-Tours’ cancellation policy shall apply. The number of days set out in the table below is calculated from the date of receipt by E-Tours of your cancellation notice.

Accommodation Requests:
If you wish to stay in single rooms or have any other special requests in respect to
accommodation, you must make such request in writing at the time of your application. You will be responsible for any extra cost of the accommodation which will vary depending upon the tour. Details of the extra costs of single rooms or double room guarantee or other special requests will be provided to you at the outset.

Alternate departure/arrival airports
If you wish to travel from alternative departure gates you must notify E-Tours in writing at the time of your application. E-Tours will endeavor to make the necessary arrangements but such arrangements will be subject to an additional surcharge plus any extra cost of the airfare which  must be paid no less than 90 days before the departure date.

Purchasing your own Airline Tickets

Participants can make their own travel arrangements and join the tour in progress, but it is the participant’s responsibility to join the tour, not E-Tours responsibility to find the participant. ETours will not be responsible for Participants who arrange their own travel until they join the tour. If Participants wish to make their own travel arrangements, they must notify E-Tours in writing by post, fax or e-mail at the time of their application.

Extending your stay

If you wish to spend extra time at the destination either before or after the tour period, you must notify E-Tours in writing at the time of your application. E-Tours will try to make the necessary arrangements but such arrangements will be subject to an additional surcharge which must be paid no less than 90 days before the departure date.

Non-participation in group activities

Should a traveler choose not to participate in a group activity which is included in the tour, no refund or reimbursement shall be given for lack of participation in those activities.

Other Information:

Passports and Visas
You must have all appropriate documentation prior to the departure date. E-Tours does not obtain passports and visas (unless specifically agreed at the outset) for Participants and if any Participant is unable to obtain the appropriate documentation prior to the tour departure date then the Participant will not be allowed to join the tour. E-Tours’ cancellation policy will apply.
Your passport must be valid for at least six months after the end of your tour. IMPORTANT!
Non-U.S. citizens should contact the embassy or consulate of your tour destination countries as soon as possible to check the entry requirements. See your tour itinerary for the destination countries.
E-Tours requires that every traveler have travel insurance coverage and has included the price of travel insurance for you in the cost of the tour. You are not required to take out your own travel insurance for the tour unless you require supplemental travel insurance.
Participants are subject to each airline’s luggage specification limits. E-Tours limits participants to one suitcase and one carry-on item. Any additional luggage will be allowed subject to the airlines excess luggage fees and to the agreement of E-Tours. The Participant will be liable for any additional luggage fees required by the airline. E-Tours shall not be responsible for any delay of, loss or damage to luggage and its contents.
Changes by E-Tours
E-Tours shall be entitled to make changes to any aspect of the tour, at any time, including but not limited to its charges, the itinerary, departure dates, transportation, accommodation or groups to which a Participant is assigned. In the event of any such change, you will be notified and any cancellations by a Participant as a result shall be subject to E-Tours’ cancellation policy and to these Terms and Conditions. E-Tours reserves the right to make changes despite special requests made by you.
Parties’ liabilities
The E-Tours official tour begins with the take-off of the flight from the departure gate and ends upon completion of the return flight to the United States unless the Participant has arranged his/her own travel, in which case the E-Tours tour begins upon the Participant joining the tour and ends upon arrival at the departure gate at the last destination country.
E-Tours, its agents, officers, group leaders, or representatives, shall not be liable to the Participant by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the agreement between the parties, for any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever which arise out of or in connection with this agreement. The Participant acknowledges and agrees that the air carrier’s liability for loss of or damage to baggage or property, or for death or injury to person is limited by their tariffs, or the Warsaw Convention, or both. Further, the air carriers assume no responsibility to any traveler save for their liability as common carriers.
The Participant agrees to comply with all local laws when abroad, including those concerning cigarettes, drugs and alcohol (and in the case of a minor, even when such laws are in conflict with parents’ permission). Minors are not allowed to drink alcohol on an E-Tours Study Tour. Failure to so comply will entitle E-Tours to send the Participant back home and the Participant will lose the right to a refund of any part of the tour costs/fees and the Participant will be charged for additional costs incurred. Further, should local authorities become involved, the Participant shall be subject to the laws of that country.
The Participant agrees to abide at all times by E-Tour’s regulations, rules and instructions of the Group Leader or E-Tour’s other employees. Failure to so abide will entitle E-Tours to send the Participant back home at their expense and the Participant will lose the right to a refund of any part of the tour costs/fees and the Participant will be charged additional costs incurred.
The Participant agrees that if he/she becomes ill or incapacitated during the tour, E-Tours may, without incurring any liability, take any action as it considers necessary under the circumstances, including obtaining medical treatment for the Participant and arranging transportation of the Participant to be returned home at the Participant’s expense in excess of participant’s travel insurance.  E-Tours shall not be liable for the quality of medical treatment obtained for the Participant and he/she shall not be entitled to any form of refund.
The Participant shall be responsible for any loss of passports, airline tickets, other documents, luggage or loss of any other passenger belongings. E-Tours is not responsible for locating lost property.
The Participant shall be responsible for paying for all telephone calls or other incidental costs and expenses incurred by the Participant during the tour.
The Participant shall also be liable to pay for any damage caused by the Participant to any third party property during the tour including but not limited to hotel rooms, buses, trains, planes, cruise ships.
The Participant shall indemnify E-Tours against any liability incurred by it which arises as a result of the Participants actions/omissions during the tour resulting in injury or damage to other persons or third party property. E-Tours shall not be responsible for the Participant in the event the Participant absents himself/herself from E-Tours supervised activities e.g. the Participant visiting friends, family or during stay ahead/ stay-behind periods if such periods do not include E- Tours services.

General Provisions

Neither party shall be liable to the other for any default due to any Act of God, explosion, flood, tempest, fire or accident, war or threat of war, terrorist activities, sabotage, insurrection, civil disturbance or requisition, acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority, import or export regulations or embargoes, strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of E-Tours or of a third party) or other event beyond the reasonable control of either party. E-Tours’ tours may be cancelled for any reason, including but not limited to instability in a destination country and such cancellation will be based on U.S. Department of State travel warnings. The agreement between the parties and these Terms and Conditions contain the whole agreement between the parties in respect to all matters which are referred to and supersedes any prior written or oral agreement between them relating to it and the parties confirm that they have not entered into this agreement on the basis of any representations that are not expressly incorporated in this agreement.
The Participant acknowledges that, in entering into the agreement and agreeing to the Terms and Conditions, it does not do so in reliance on any representation, warranty or other provision except as expressly provided in this agreement, and any conditions, warranties or other terms implied by statute or common law are excluded from this agreement to the fullest extent permitted by law. If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected. The agreement and these Terms and Conditions shall be governed by and construed in accordance with the laws of The United States of America and each party Agrees to submit first to arbitration in Tarrant County, Texas for any disagreements that may arise subsequently to the non-exclusive jurisdiction of the Courts of The United States of America.
